Civil protection shelters: diagnosis, priorities and investment preparation

What the legal framework says, who is responsible for what depending on ownership and management, and what a local administration can do before commissioning technical expert assessments and designs.

Distinctions

Three different things that are often confused

They are not equivalent, either technically or legally. Confusing them produces documents that do not stand up to inspection and investments that do not solve the problem they were made for.

1

Civil protection shelters

Spaces specifically designed or fitted out to protect the population, within the framework set by Law 481/2004 on civil protection and Government Decision (HG) 862/2016. Construction parameters, actual condition and operating conditions are established by specialist technical inspection, not by an administrative inventory.

3

Multi-use community buildings

Multi-purpose hall, school, cultural centre, sports facility. They can take in people in emergencies, if this role is set through planning and if the building can support it. They do not become shelters through an administrative decision.

Legal framework

The legislation that matters

Consolidated versions must be checked at the date of use. Below is what each act regulates, without added interpretation.

Legal actWhat it regulates
Law 481/2004 on civil protection, republished The general framework for civil protection: the rights and obligations of citizens, the responsibilities of public administration authorities, the sheltering of the population.
HG 862/2016 The categories of buildings for which civil protection shelters are mandatory and those in which command posts are set up. Published in Monitorul Oficial (Romania's Official Gazette) No. 955 of 25 November 2016, under Article 45(4) of Law 481/2004. It replaced HG 560/2005.
OMAI 1494/2006 The organisation and operation of camps for disaster victims in emergencies. Published in Monitorul Oficial No. 926 of 15 November 2006. It does not contain the technical rules for civil protection shelters.
Government Emergency Ordinance (OUG) 21/2004 The National Emergency Management System: its structures, responsibilities and decision-making chain in emergencies.

Responsibilities

Who is responsible for what

Responsibility follows ownership and management, not office. The statement “the mayor manages all shelters within the locality” has no basis in law.

Public shelter stock

The authority or institution that owns or manages the space is responsible, with its own budget and responsibilities.

Local authorities

The mayor and the local council have the civil protection responsibilities set by Law 481/2004 for the administrative-territorial unit (UAT). Their extent is read from the law, one responsibility at a time, not by analogy.

Emergency structures

Technical inspection, approval and intervention remain with the competent structures and specialists, in line with their legal responsibilities.

What we do and what we do not do

ARSC's role in this area

1

Documentary analysis

What the administration's records contain about shelter spaces: documents, record sheets, permits, official reports, previous decisions.

2

Structuring the information

Scattered information becomes a usable list: which space, where, owned and managed by whom, what is known about it and what is not.

3

Prioritisation

Ranking interventions on criteria agreed with the beneficiary: population served, declared condition, usefulness in the scenarios in the diagnosis, estimated cost.

4

Project preparation

Project sheets with justification, objective, indicative budget, maturity and the next preparation steps, including which technical expert assessments are needed before any investment decision.

What this service does not include. Technical expert assessment, design, permitting and construction are carried out by the competent specialists and operators, as separate services. Documentary analysis does not replace a technical expert assessment: it does not establish whether a space can be used as a shelter, how long it would take to adapt, or what protection it would offer.

Funding

Where the works can be funded from

The honest answer, as of 14 October 2026: there was no open call dedicated to sheltering, with a published guide, to which a Romanian administrative-territorial unit could apply.

What had been announced

A regional call for defence infrastructure and the protection of critical infrastructure, with the guide expected in November 2026 and the opening expected in December 2026, for the Bucharest-Ilfov region. Eligible applicants were not specified in the published calendar.

What remains to be watched

Calls under the EU Civil Protection Mechanism and the regional programmes, following programme amendments. For public buildings, the open call on solar energy and storage may cover backup power.

We start with what already exists in your records

A 30-minute call, then a technical and financial proposal, contracting through the applicable procedure and the start of the project.
